Walla Walla Police say they think the 30 times that 24-year-old McDonald’s employee Frank Avbel had sex with his recent house guest was consensual. The problem is, the girl in question is 14 years old. Avbel’s brother Allan is allegedly also a fan of 14-year-olds. The cops say that while Frank was shacked up with his girl, Allan hooked up with his own teen. Now, since their arrest on Thursday night, the two are facing a combined 31 counts of 3rd-degree rape of a child.The Daily Weekly talked with Walla Walla Police Officer Tim Bennett, who said that the case came to light after an Oct. 24 booze-soaked party at the house brought an enraged parent to come claim her daughter. In the two weeks that followed, one of the girls’ stories about how she’d spent the past several days crashing at Chateau de Avbel came out. Other witnesses apparently had similar stories. The brothers are no strangers to crimes involving kids. Both were arrested back in July for having another party at their house where they got several young kids drunk. In all, Bennett says they’ve responded to calls 16 times at the house since 2009 for burglaries, assaults and liquor violations.All the charges facing the brothers are Class C felonies. Washington state law defines 3rd-degree rape of a child as:A person is guilty of rape of a child in the third degree when the person has sexual intercourse with another who is at least fourteen years old but less than sixteen years old and not married to the perpetrator and the perpetrator is at least forty-eight months older than the victim.Bennett cut through the legalese. “If the guy was 14 and the girl was 14, there’d probably be no crime,” says Bennett. “Obviously, though, there’s some age discrepancy here.”Bennett says he believes the Avbel brothers have assaulted at least two other young girls. He’s asking for parents and witnesses who know more to come forward.
