In losing a patent case to little known corporation i4i over Microsoft Word’s use of XML, Microsoft’s lawyers repeatedly compared i4i to bankers receiving federal bailout dollars and implied that the non-practicing owner of a patent couldn’t sue for infringement, said Judge Leonard Davis. More specifically, “All these arguments were persistent, legally improper, and in direct violation of the Court’s instructions.” The price tag for that: A $40 million fine, bringing Microsoft’s total bill to $290 million. For a cheap analogy, that’s pretty pricey.
