How much pain and suffering comes with a case of genital herpes you unknowingly contracted from a 69-year-old former dentist you met on eHarmony? According to a jury in Portland, the figure is $900,000.
According to an account of the case on the Q13 Fox website, the man - whose name has also been kept secret - failed to use a condom when the couple had sex for the first time, even after the woman had asked him to wear one. Naturally, Romeo only revealed he had herpes after the deed was done. According to reports, he broke the big news while the couple was snuggling in bed after sealing the deal.
From the Oregonian:
He seemed well-educated, charming and kind. They had a lot in common, including that she was a dental hygienist and he was a retired dentist. On the fourth date -- an evening that included hors d'oeuvres, wine and a few puffs of pot -- the two had sex.
The woman was looking for a husband. Instead, she ended up with genital herpes.
Of course, the man had a different perspective on how things went down. His lawyers (predictably) argued that the woman was being untruthful about her sexual history and could have contracted the disease from someone else. They also contended she acted irresponsibly, maybe even bringing the herpes upon herself.
More from the Oregonian:
[The man] testified that he told her that he had herpes not out of guilt, as she contended, but because he liked her and wanted her to know there might be times when he had an outbreak and he would have to refrain from sex.
His attorney argued that the woman was careless -- that she should have demanded he wear a condom because without one "everyone knows you're at risk for an STD."
"Grow up. Come on. You're an adult. He's an adult. They had sex," Lillegren said. "The point is she is not some little innocent victim."
Whether she's an innocent victim or not, she is $900,000 richer. That sure to soothe her next outbreak at least a little.
