Weldon Marc Gilbert stands accused of raping and molesting multiple young boys and videotaping himself while he did. Police also found around 28 hours of child porn on more than 100 DVDs in his house.
And while that massive collection of kiddie porn may be illegal, because Mr. Gilbert is acting as his own attorney in his case, he'll have the chance to watch as much of the porn as he wants from the comfort of jail--all in an effort to "prepare his case."
KOMO reports that a legal loophole laid out by the Washington Supreme Court will allow Gilbert his child-porn movie marathon, and there's nothing prosecutors, the sheriff, or anyone else can do about it.
"Make no mistake -- I don't like it," said Pierce County Sheriff Paul Pastor. "But it is not my choice whether to do it or not to do it. There's no question that I don't like it. There's no question that this makes me grind my teeth." or a judge can do about it.
Pierce County Prosecutor Mark Lindquist is even more pissed. He tells ABC News:
"In my 16 years as a prosecutor, this is one of the most absurd and maddening results I've ever heard of, and this is the first time I'm aware of this happening in Pierce County. We don't have to turn over the guns used as evidence for a defendant . . . and it's absurd that we have to turn over the child porn as evidence."
Apparently Gilbert will be put in a special private room whenever he wants to watch the porn. Can't imagine what an accused habitual child molester would do in a private room with a massive haul of kiddie porn.
